In a recent development, the Delhi High Court ordered the plaintiffs, Mihir Diwakar and wife Soumya Das, to notify Chennai Super Kings (CSK) captain and former India champion Mahendra Singh Dhoni about the defamation suit that was filed against him earlier this week. This directive was issued on Thursday, January 18. The issue concerned the purportedly untrue charges made against Diwakar and Das.
For the maiden hearing before Justice Pratibha M. Singh of the Hon’ble High Court, the cricket player was expected to appear. Nonetheless, Dhoni or any of his representatives did not appear at the tribunal as the defendant in the case. Because of this, the cricket player will now receive notification prior to the upcoming hearing, which is set for January 29.
Remarkably, as per a signed contract in 2017, Dhoni and Mihir Diwakar had partnered to create cricket academies in India and around the world under the names “MS Dhoni Sports Complex,” “MS Dhoni Cricket Academy,” or “MS Dhoni Sports Academy” for Aarka Sports Management. Nevertheless, Dhoni accused Mihir Diwakar of continuing to conduct business using the aforementioned names after the permission to do so was revoked in a criminal conspiracy lawsuit that he filed.
Bar and Bench claims that Dhoni’s attorneys staged a press conference on January 6 at which they accused Mihir Diwakar and Das of a number of offenses under the Indian Penal Code, including forgery, cheating, forgery with the intent to cheat, passing off forged documents as authentic, and criminal conspiracy.
An announcement will be given to Dhoni’s legal firms, Dayanand Sharma and associates, that they will be representing the 42-year-old in the defamation claim on the day of the hearing. Dhoni is currently being represented in Ranchi’s District Court for a criminal conspiracy case against Diwakar.
News Agency ANI questions the suit’s maintainability
Notably, Mihir Diwakar attorneys are attempting to remove all of the purportedly untrue charges that have been spread over a number of social media platforms, including Google, Meta, YouTube, and X, on the grounds that they are damaging his reputation. One of the defendants in the lawsuit, the news organization ANI (Asian News International), was present for the hearing on Thursday.
ANI contested the suit’s maintainability by telling the court, through its attorney Siddhant Kumar, that they just disclosed information about the ongoing criminal case against the plaintiff and had no desire to damage their character or image.
Hon’ble Justice Pratibha M. Singh has now postponed the hearing until January 29 after giving it careful thought.
