The chargesheet against JKCA's Farooq Abdullah and associates is dismissed by the Jammu-Kashmir High Court

A chargesheet was issued by the Enforcement Directorate (ED) against Farooq Abdullah, the former chief minister of Jammu and Kashmir, and other individuals in relation to money laundering claims of irregularities in the Jammu and Kashmir Cricket Association (JKCA). The state’s High Court dismissed the accusations brought by the ED on August 14.

In light of the fact that none of the accused had committed an established crime, the chargesheet was invalidated, according to Justice Sanjeev Kumar, who anticipated the proceedings.

The charge sheet filed by the ED included Farooq Abdullah, the head of the National Conference, as well as Ahsan Ahmad Mirza, a former JKCA treasurer, Mir Manzoor Gazanffer, and other individuals.

Misrepresentation of funds obtained by JKCA from BCCI is the subject of a charge sheet filed by the ED. According to reports, from 2005–2006 to 2011–2012 (up until December 2011), Rs 94.06 crore was received in three separate bank accounts. Abdullah, Mirza, Gazanffer, and former accountants Gulzar Ahmad Beigh and Bashir Ahmad Misgar were consequently charged with embezzling Rs 43.69 crore in JKCA funds.

Following this, the ED filed a case using the 2018 charge sheet that the CBI had filed against Abdullah and his subordinates, attaching assets valued at Rs. 21.55 crore and citing three earlier orders. In addition, the charge sheet states that ED detained Mirza in November 2019, and the case is currently pending.

Shariq J Reyaz acted as Mirza and Gazanffer’s legal representative when the latter contacted the High Court to ask that the ED’s case be dismissed.

The ruling was postponed until August 7 when Additional Solicitor General S V Raju presented the ED’s case. Reyaz, however, highlighted the court’s ruling in their favour by stating, “our plea that no predicate offence was made out.” The fact that ED lacked jurisdiction over the aforementioned issue was also emphasised by him.
